SAN FRANCISCO, Jan. 23, 2019 /PRNewswire-PRWeb/ — The San Francisco law firm Gaw | Poe LLP today filed a lawsuit against United Airlines, Inc. on behalf of a passenger on its October 27, 2018, Flight 931 from Chicago to London. As alleged in the lawsuit, on that day, Flight 931 made an emergency descent from 40,000 feet to land at the Goose Bay airport in Canada. The lawsuit alleges that the cause of this emergency landing was because the cockpit window for the Boeing 767-300 had shattered, with two of its three layers having been completely compromised.

And as alleged in the lawsuit, the reason why Flight 931’s cockpit window shattered was because a United mechanic had over-torqued the bolts of the cockpit window. As alleged in the lawsuit, however, United’s customer service personnel have already been instructed to respond to inquiries by explaining that the accident was caused by a “bird strike.” In addition, as alleged in the lawsuit, United Airlines had also inexplicably prevented any passengers from deplaning Flight 931 for nearly 8 hours following its emergency landing.

The lawsuit brings a claim arising under the Montreal Convention on behalf of Gaw | Poe’s client for his bodily and mental injuries suffered as a result of this incident. The lawsuit seeks to hold United Airlines both strictly liable, and liable in negligence pursuant to the terms of that treaty. “My client is still struggling with the injuries he suffered, and he deserves fair compensation for them,” said Randolph Gaw, plaintiffs’ attorney and a founder of Gaw | Poe LLP. Gaw added, “United made billions of dollars in profits last year, and it’s insulting that they think a $500 voucher is a fair trade for what happened to my client.”

The case is captioned Theodore Liaw v. United Airlines, Inc., et al., Case No. 3:19-CV-00396, and is filed in the United States District Court for the Northern District of California.
