SAN FRANCISCO – October 5, 2023 – Gaw | Poe LLP announced today that it was awarded $862,314.32 in attorney’s fees and $33,410.48 in costs as the culmination of its’ clients civil RICO lawsuit against Tauler Smith LLP—the law firm that had sent numerous demand letters to various small retail stores accusing them of selling certain sexual enhancement pills in violation of federal law. Earlier this year, Gaw | Poe prevailed at a jury trial on behalf of its clients when it obtained a verdict that found that Tauler Smith had violated the federal Racketeer Influenced Corrupt Organizations Act (“RICO”) by sending those demand letters. These fees and costs were thus awarded pursuant to the statutory fee-shifting provisions of the RICO statute.
The lawsuit is captioned In re Outlaw Laboratories LP Litigation, No. 18-CV-840-GPC-BGS, and the trial was held before Judge Gonzalo Curiel of the United States District Court for the Southern District of California. The retail stores counterclaimants were represented in this lawsuit by Gaw | Poe LLP attorneys Mark Poe and Randolph Gaw.
