SAN FRANCISCO (PRWEB) June 05, 2018 — Gaw | Poe LLP is proud to announce that its co-founding attorney, Mark Poe, achieved the distinction of winning two different eight-figure appeals for two different clients before two different courts on the same day last week – May 31, 2018.
On the morning of May 31, the United States Court of Appeals for the Fourth Circuit issued an opinion affirming the confirmation of an $11,281,681.46 million arbitration award that Mr. Poe had obtained for his client Ronald Barranco against 3D Systems Corporation, the largest 3-D printing company in the world. The arbitrator had found that 3D Systems breached a contract with Mr. Barranco by taking steps to deprive him of the opportunity to achieve potential earnout payments under that contract arising from his sale of his business (Print3D) to 3D Systems. Mr. Poe was the lead appellate attorney for Mr. Barranco and successfully opposed 3D Systems’ request to the Fourth Circuit to vacate that arbitration award.
Then, in the afternoon of May 31, the California Court of Appeal for the First Appellate District issued an opinion affirming a defense judgment obtained for his clients Nasir Javaid and DeJauna Joseph following a bench trial in the San Francisco Superior Court. Mr. Poe’s clients had been unsuccessfully sued by Joseph Tierney, a local real estate developer, who had sought to enforce the terms of an option contract that would have forced them to sell to Mr. Tierney San Francisco commercial real estate worth over $10 million for the option price of $3 million. Mr. Poe was the lead appellate attorney for his clients in the resulting appeal and successfully opposed Mr. Tierney’s request to the Court of Appeal to reverse or vacate the judgment.
The respective appellate proceedings are captioned Barranco, et al. v. 3D Systems Corp., et al., No. 17-1744 before the United States Court of Appeals for the Fourth Circuit and Tierney, et. al. v. Javaid, et al., No. A147221 before the California Court of Appeal for the First Appellate District, Third Division.
