As reflected in its March 30, 2016 verdict, a federal jury awarded Gaw | Poe LLP client Trendsettah USA $44.4 million in its antitrust and breach of contract lawsuit against Swisher International, Inc., the largest cigarillo manufacturer in the country. Following less than 3 hours of deliberation, the jury agreed with Trendsettah that Swisher had deliberately breached the parties’ manufacturing contract in order to stifle the growth of Splitarillos, the Trendsettah-labeled cigarillo, which was becoming a popular challenger to Swisher’s market-leading cigarillo brands. The lawsuit is captioned Trendsettah USA, Inc. v. Swisher International, Inc., No. 8:14-CV-01664-JVS-DFM and is pending in the United States District Court for the Central District of California.
